The article analyzes the norms of land legislation, legislation on urban development, and environmental protection in the context of the concept of placement used in relation to capital buildings and structures. As part of the research, the author studies the terminology used in the sphere of regulation of land, urban planning, forestry, and environmental relations, as well as the content of the procedures established by law in the context of the concept under study. The importance of this study is determined by the fundamental importance of an unambiguous interpretation of this concept for the registration of rights to publicly owned land plots. Based on the completed research, the author concludes that the current environmental and urban planning regulations need to be clarified in certain provisions.
В статье анализируются нормы земельного законодательства, законодательства о градостроительной деятельности, об охране окружающей среды в разрезе используемого в отношении капитальных зданий и сооружений понятия размещение. В рамках проводимого исследования автор изучает терминологию, используемую в сфере регулирования земельных, градостроительных, лесных, природоохранных отношений, а также содержание установленных законодательством процедур в разрезе исследуемого понятия. Важность настоящего исследования обусловлена принципиальным значением однозначного толкования данного понятия для оформления прав на земельные участки публичной собственности. На основе выполненного исследования автор резюмирует, что действующее экологическое и градостроительное регулирование нуждается в уточнении отдельных предписаний.
