Object and subject of fraud in the field of lending under the criminal legislation of the Donetsk People's Republic

Abstract

Subject of research: criminal law categories – the object and subject of fraud in the field of lending, responsibility for which is provided for in Art. 166 of the Criminal Code of the Donetsk People's Republic (hereinafter – the Criminal Code of the DPR), in the context of the content of property relations regulated by the civil legislation of the Donetsk People's Republic (hereinafter – the DPR).

The purpose of research: to identify substantive shortcomings in the formulation of the object and subject of the crime under Art. 166 of the Criminal Code of the DPR, followed by a proposal for options for their elimination.

Methods and objects of research: to obtain the results of the study, the methods of cognition used in the humanities (legal) sciences were used. The content analysis method was used in the study of the content of the relevant provisions of the criminal and civil legislation of the DPR in terms of determining the object of criminal law protection against theft in the field of lending. The method of system analysis was used in studying the issues of providing adequate criminal law protection of public relations in the field of lending. Dialectical and formal-logical methods were used in assessing the quality of the differentiation of criminal liability for fraud in the field of lending and other theft committed by deceit or breach of trust, carried out by the legislator of the DPR.

Results of research: the content of the subject of the crime under Art. 166 of the Criminal Code of the DPR, needs an extensive official interpretation. To do this, it is necessary to extend the scope of Art. 166 of the Criminal Code of the DPR on relations based on a loan agreement. The subject of fraud in the field of lending must be recognized not only as cash and non-cash funds, but also other property, as well as property rights, as defined in Art. 168 of the Civil Code of the DPR.

Criminal liability for criminal air pollution: current problems and solutions

Abstract

The subject of the present research is the mechanism of criminal law protection of atmospheric air from negative anthropogenic impact on it.

The purpose of the research is to identify and update the shortcomings of Article 251 of the Criminal Code of the Russian Federation, which establishes criminal liability for criminal air pollution, as well as to propose ways to eliminate them.

The methodological basis of the research is the formal legal method, the method of content analysis, as well as methods of induction and deduction. In the study of Article 251 of the Criminal Code of the Russian Federation, the content analysis method was used. The formal legal method is applied in the analysis of such concepts as "air pollution", "other changes of the natural property of air". Based on the deduction method, legally significant signs of criminal pollution of the atmosphere are determined. Using the inductive method, the research of the level of danger of anthropogenic impact on the atmosphere was managed.

As a result of the research, the difficulties of law enforcement practice of Article 251 of the Criminal Code of the Russian Federation are revealed, ways of overcoming them are determined. The problems of distinguishing between criminal air pollution and an administratively punishable offense provided for in Article 8.21 of the Code of Administrative Offences of the Russian Federation, the absence of clarification in the Criminal Code, as well as by the Plenum of the Supreme Court of the Russian Federation of the concept of "other change in the natural properties of the air", the absence of terminological unity of the Criminal Code of the Russian Federation and the relevant legislation, special attention is paid to the consideration of the subjective side of the crime, and also the contradictory approach of legislators, to identify qualifying signs of criminal pollution of the atmosphere.

The prospect of criminalization of crimes against humanity in Russian criminal legislation

Abstract

Introduction. Currently, Russian criminal legislation lacks an independent norm on crimes against humanity. The author considers this to be a serious gap in the system of crimes against the peace and security of mankind (Chapter 34 of the Russian Criminal Code).

Methods. The conclusions made in the article are the result of using the general scientific dialectical method of cognition, as well as private methods (analysis, synthesis, formal-logical).

Tasks. The author in this article seeks to substantiate the need for direct criminalization of the norm on crimes against humanity in the criminal legislation of Russia.

Results. The article analyzes doctrinal positions regarding the possibility and/or necessity of criminalizing crimes against humanity in national criminal law. The provisions of the norms of international law in force for Russia are also taken into account to address the issue of criminalization of crimes against humanity in the Russian Criminal Code.

Conclusions. The article defines the following grounds for the criminalization of crimes against humanity in the Russian criminal legislation: international legal; constitutional and legal; political-legal and socio-legal. When formulating a rule on crimes against humanity in the Russian Criminal Code, the provisions of the statutes of post-war tribunals and modern ad hoc criminal tribunals recognized by Russia should be used. This rule should follow the traditional techniques of legislative technique and take into account a single «contextual element» inherent in all specific types of crimes against humanity.

Formation of the concept of crisis situation with respect to the criminal executive system

Abstract

Subject of research: the state of the national security of the Russian Federation directly depends on the degree of implementation of strategic national priorities and the effectiveness of the functioning of the national security system. One of the national priorities of the Russian Federation is the readiness of the forces and means of the Federal Penitentiary Service of Russia to counteract crisis situations that arise in penitentiary institutions. To date, there is no single concept of a crisis situation, which allows us to form this concept in relation to the penitentiary system.

Purpose of research: based on the analysis of the conceptual apparatus of a crisis situation, to formulate a scientifically substantiated author's concept of this phenomenon in relation to the penitentiary system.

Methods and objects of research: the article uses such general scientific research methods as: generalization, analysis and synthesis, concretization.

Main results of research: legislative indicators for the formation of the opinion of federal executive bodies and the need for in-depth development of problems related to the concept of a crisis situation are determined. The stage of developing opinions on fixing the concept under consideration in the normative acts is subjected to a detailed analysis. The legislative introduction of the concept of a crisis situation will make it possible to form a legislative framework and regulate the issues of interaction between the Federal Penitentiary Service of Russia and federal executive authorities.

Criminal protection of Russia's fiscal interests in the foreign economic sphere

Abstract

Subject of study: in the context of economic sanctions against Russia, the issue of international trade with foreign partners is more relevant than ever. Improving the quality of customs administration and the transition from "electronic" to "intellectual" customs, gives positive results, which are the subject of study by economists and lawyers in the field of customs. “Behind the brackets” are questions of the effectiveness of the criminal law protection of the fiscal interests of the state in the foreign economic sphere. An analysis of the statistical data of courts, customs and other law enforcement agencies made it possible to develop probable hypotheses for the future development of crime in this area, which is the subject of this study.

The purpose of the study: to formulate evidence-based proposals for improving the mechanisms of criminal law protection of the fiscal interests of the state in the field of foreign economic activity.

List of methods and objects of research. Statistical observation, a method of grouping and summarizing data with subsequent interpretation of the results, which made it possible to make a forecast for the effective protection of the state's fiscal interests in the foreign economic sphere.

Conclusions on the results of the study. The mechanisms of criminal law protection of the state's fiscal interests in the customs area should be of an exceptional nature, and the guidelines should be built in favor of the transparency of customs procedures and the profitability of doing honest business. Currently, there is a decrease in the number of convicts under Art. 194 of the Criminal Code of the Russian Federation with a significant increase in voluntary forms of payment of arrears on customs payments. Two main reasons have been identified: organizational – improving the quality of customs administration; legal – judicial practice is built on the principle of presumption of good faith of the declarant.

The purpose of research: to evaluate the presented study for compliance with the requirements for scientific qualification works of this type.

Methods and objects of research: in the process of studying the dissertation research, E.M. Stone used various methods of scientific knowledge, namely: dialectical, formal-logical, system-structural, analysis, synthesis, etc.

Main results of research: dissertation prepared by E.M. Stone, meets all the requirements that apply to scientific work of this type. The dissertation makes a certain contribution to the solution of the problem posed, is an actual independent scientific research, which has a complete form, is based on a sufficient empirical base, which ensures its reliability; the conclusions and proposals contained in it have scientific novelty and practical significance.

Basic properties of foamconcrete on quartzcement binder

Abstract

Subject of research: the article considers foamconcrete on quartz cement binder, the mass introduction of quartz raw materials in construction can be considered practically achievable and economically profitable.

Purpose of research: the technology of foam concrete on quartz-cement binder is proposed – by introducing an ultrafine filler (nanomodifier) from activated quartz waste into the binder, reduces cement consumption by 10 % and improves its physical and mechanical properties.

Methods and objects of research: the nanomodifier was obtained with mechanical and mechanohydraulic activation, the proposed filler activation technologies will improve the structure of cement stone forming foamconcrete pore-forming partitions by increasing the packing density and chemical activity of nanoscale particles in the processes of hydrate compounds phase formation.

Main results of research: the proposed technology of heat-insulating foamconcrete on quartzcement binder allows you to create a pore structure with a diameter of 52 microns at a density of 500 kg/m3 foamconcrete samples and a total porosity of 65–75 %, and will also increase the strength characteristics of foamconcrete to 7.7–13.8 % due to discrete reinforcement with quartz waste (nanomodifier) of pore-forming partitions.

Dependence of TBP (true boiling point) curve for oil on the method for determining the fractional composition

Abstract

The subject of this study is the study of methods for determining the fractional composition of oil.

The purpose of this work is to assess the influence of the method of determining the fractional composition on the oil TIC on the example of the Salymskoye field.

This article describes the comparative results of determining the fractional composition of the oil of the Salym field, obtained by three different methods: atmospheric vacuum distillation, the Engler method, simulated distillation in a gas chromatographic column.

The results obtained show which currently depends on the goals and objectives is a more effective method for the study of heavy oils, oil residues and petroleum products.

Study of the TIG weldability of aluminum matrix composite material AMg2-TiC

Abstract

Subject of research: Weldability of the composite alloy AMg2-TiC.

Purpose of research: Matrix alloy AMg2 is often used in welded joints. Reinforcement with a highly dispersed ceramic phase of titanium carbide leads to an increase in the hardness and strength of the alloy; therefore, it is necessary to study how the composite material behaves during and after welding.

Methods and objects of research: The object of study is the AMg2-TiC composite alloy obtained by the method of self-propagating high-temperature synthesis. Microstructural analysis was carried out on a Jeol JSM 6390A scanning electron microscope. The elemental composition was determined by X-ray microanalysis on a Jeol JSM 6390A scanning electron microscope with a Jeol JED-2200 attachment. The hardness of the samples was determined on a hardness tester ZIP TK=2M using the Brinell method according to GOST 9012-59. Weldability tests were carried out by argon-arc welding using an Everlast Power TIG 210 EXT welding inventory and filler materials that most closely match the chemical composition of the matrix alloy.

Main results of research: This paper shows the possibility of welding a composite material using the TiG method. The weldability of the composite was rated as satisfactory. Highly dispersed particles of the reinforcing phase do not dislocate from the area of ​​the base metal to the area of ​​the weld. The hardness of the composite material after argon-arc welding does not fall, but remains at the same level. The porosity in the weld zone of the composite is less than in the weld zone of the matrix alloy.

Extension of the functionality of the software for MD-simulation of the SH-synthesis of intermetallides in Ni-Al and Ti-Al nanosystems

Abstract

The subject of research: the methodological and functional capabilities of specialized software packages of free access LAMMPS and OVITO and author's programs used for simulation of SHS-microkinetics in heterogeneous systems.

Purpose of research: to increase information content, 3D-visualization, and adequate interpretation of the processes of structural-phase transformations at interfaces of the layered, layered-block nanoscale Ni-Al and Ti-Al systems.

Methods and objects of redearch: the molecular dynamics simulation method implemented in the basis of the LAMMPS software package simulates the process of initiation and propagation of the SHS combustion wave in the systems under study, and using the OVITO package, 3D-visualization of the processes of dissolution, diffusion, and motion of the SHS combustion wave front is carried out.

Main results of research: it is shown that the development by the author of software modules for calculating one-dimensional temperature and density profiles of the synthesized material along the direction of combustion wave motion, as well as for calculating and visualizing the 3D-structure of the distribution of synthesized intermetallic interlayers at the interface in nanoparticles with the Ni-Al "core-shell" structure (and similarly for Ti-Al) allows, in contrast to the OVITO package, to detect heterophase intermetallic structures in such systems. As a result of a large series of computational experiments on simulation of microkinetics in the studied nanoscale Ni-Al and Ti-Al systems, it has been established that the software package created by the author with support for parallel computing, which, in addition to the licensed packages LAMMPS and OVITO, integrates author's software modules, has new broader functionality in the methodological aspect of the study of the problems of physical chemistry of the SHS process and is a vivid example of the created software engineering tools in this area of research.

Study of electric drive with thyristor voltage regulator

Abstract

In the modern world, the electric drive has tasks of different nature, depending on the application and technological process. At the moment, induction electric drives, which operate by direct start, are widely used. This method has negative factors: high starting currents at the launch; impact loads on the mechanical system. During continuous running mode of the electric motor with direct start, its resource and mechanical system is reduced. Thyristor voltage regulators is used extensively to solve this problem. Ramp generators are used for soft start, the parameters of which determine the settling time and how efficiently the peak currents and torques will be reduced.

Object of research: induction electric drive with thyristor voltage regulator.

Purpose of research: research of parameters of ramp generator for electric drive with thyristor voltage regulator.

Methods of research: numerical methods for solving differential equations, functional diagrams, control system topology, electric drive theory.

Main results of research: A generalized algorithm for the control system of thyristor voltage regulator keys is presented. An analysis was made for parameters of ramp generator in the electric drive with thyristor voltage regulator.

Intelligent voltage regulation system in the distribution electrical network based on fuzzy logic

Abstract

The paper considers the issues of voltage regulation in the distribution network. The possibility of using fuzzy logic implemented in a fuzzy controller for voltage control is shown.

The purpose of the study: to increase the resource of switches of voltage regulators of power transformers when controlling voltage and reactive power modes of distribution electrical networks.

Subject of research: the introduction of a fuzzy controller in the voltage level control system in the distribution electrical network.

Methods and objects of research: the study was conducted using numerical simulation, fuzzy logic methods. The objects of the study were the distribution electrical network as well as power transformers equipped with voltage regulators, adjustable compensating devices working together under the control of a fuzzy controller.

Results of research: based on the conducted experiments, it was shown that the joint use of voltage regulation means (transformers, compensating devices) in the distribution electrical network when controlling a fuzzy controller allows to increase the resource and extend the service life of transformer switching devices.

Investigation of the consistency of changes in the wavelet phase characteristics of heliocosmic and climate variables and changes in the components of the world water balance. Part 1

Abstract

The relevance of research is due to the need to establish the true causes and patterns of changes in the hydrometric characteristics of the world water balance, which determine the global climate on Earth.

The purpose of research: to establish the patterns and causes of changes in the world water balance variables on Earth: the availability of ground and groundwater, river flows on continents, on land, components of the World Ocean water balance in anomalies, changes in the atmospheric regime, the level of lakes, the Caspian Sea, mountain glaciers, clouds and other natural environments, given in the form of time series, due to changes in heliocosmic and climatic factors under the influence of the barycentric movements of the Sun, which determine the climate on Earth.

The objects of research: time series of heliocosmic and global climate variables, hydrometric components of the world water balance.

The methods of research: a method developed by the author for the interaction of observations of a variable or variables with groups of given heliocosmic and climatic factors in the frequency and time domains, obtained using wavelet transforms with the calculation of phase-frequency and phase-time characteristics of observations in equal time intervals; comparative analysis of changes in the obtained phase characteristics of groups of variables with the calculation of their consistency matrices and plotting in the frequency and time domains.

Results: two groups of variables are involved in cyclic climate change on Earth, hydrometric characteristics of the world water balance, natural environments: heliocosmic (barycentric motions of the Sun, solar activity, long-term solar insolation, volcanic eruptions and greenhouse gases, ozone concentration in the ionosphere, elements of the Earth's orbit, geomagnetic field, magnetic field of the Sun) and global temperature climatic variables due to changes in heliocosmic factors, the leading of which is the barycentric motion of the Sun. By analyzing the wavelet phase-frequency and phase-time characteristics of the group of hydrometric characteristics of the world water balance, heliocosmic and climatic variables in the phase-frequency and phase-time domains, the dependences of changes in the hydrometric characteristics of the world water balance by changes in heliocosmic and climatic variables in the phase-frequency and phase- temporary areas. These dependencies are presented in two figures with many graphs and two correlation matrices. They characterize the variability of the components of the world water balance by changes in heliocosmic and climatic variables in two areas in the observed time interval and are reflections of changes in the self-organizing climate system. In changes in the phase-time characteristics of groups of factors, lattice structures of differently and unidirectional changes in variables are observed, which characterize the cyclical nature of climate changes on Earth.

Studying the dynamics of thermokarst lakes in the West Siberian Arctic based on the analysis of time series of satellite measurements

Abstract

Subject of research: article is the time series of changes in the area of thermokarst lakes in the Arctic under the conditions of modern climatic changes.

Purpose of research: to analyze the time series of satellite measurements of lake areas for studying the dynamics of lakes in the West Siberian Arctic.

Methods and objects of research: we present the results of formation and analysis of time series of lake areas intended for studying the dynamics of thermokarst lakes in the Arctic zone of Western Siberia over a 36-year period. The time series were obtained based on the results of remote measurements of the lake areas on the territory of 627 thousand km2 using 688 Landsat satellite images, sampled in the period 1985-2021. The study area was divided into three ecoregions to analyze the territorial features of the vast Arctic zone of Western Siberia. The analysis of the time series showed that the change in the average lake area in the territory of the Arctic zone of Western Siberia exhibits a marked negative linear trend.

Main results of research: based on the comparison of the trends in the time series of lake areas in the territories of the three ecoregions of the West Siberian Arctic, it was found that the thermokarst lakes of Yamal exhibit the highest rate of change in the areas compared to the other Arctic ecoregions.

Structural and energy properties of bivacansions in CuAu I alloy

Subject of research: model alloy CuAu I.

The purpose of research: to study the influence of divacancies of various types on the structural and energy characteristics of the alloy.

Methods and objects of research: computer experiments were carried out using the method of molecular dynamics for the calculation block of an ordered CuAu I alloy with the L10 superstructure.

The main results of research: the formation energy of each type of divacancy and the energy gain of the divacancy compared to two non-interacting vacancies were calculated, the most energetically favorable type of divacancy was determined, and the patterns of displacements of atoms near this type of defect were shown.

Investigation of the problem of representation of a linear functional in the form of a scoal product

Abstract

Subject of research: the problem of representing a linear functional in the form of a scalar product in the Hilbert space. For example, this may be the Dirichlet problem for a second-order elliptic equation in variational form.

Purpose of research: to present a general scheme of the method of iterative extensions for solving elliptic boundary value problems with Dirichlet conditions.

Methods and objects of research: the object of study in such a problem can be the deformation of the membrane. A continuation of the considered problem in the Hilbert space is given. The extended problem is considered in a subspace of the Hilbert space. The extended problem is studied by the method of iterative extensions in the Euclidean space. An algorithm for implementing the method of iterative extensions is given.

Main results of research: as a result, it turns out that the general scheme of the method of iterative extensions as applied to the solution of a boundary value problem with Dirichlet conditions for an elliptic equation does not depend on the order of this equation. An example is given to illustrate the conclusion about the efficiency of the method of iterative extensions.

Approaches to the development of an innovative educational ecosystem as the basis for improving the quality of human capital

Abstract

Subject of research: the ecosystem approach is becoming more widespread in the management of business companies, non-profit institutions and public administration which proves its effectiveness and efficiency. The article attempts to generalize theoretical ideas about the role of innovative educational ecosystems in the development of human capital. This provides founds for the importance of the ecosystem approach in improving the quality of higher education.

Purpose of research: it’s to substantiate the effectiveness of the ecosystem approach in higher education. The goal is achieved through an analysis of the practice of ecosystem interactions between enterprises of the real sector of the economy and the university in managing the development of human capital.

Methods of research: key approaches to the study of innovative educational ecosystems are identified using general scientific methods of generalization, analysis and synthesis. Using the methods of case studies and structural analysis, the principles of functioning of modern innovation and educational ecosystems are determined. Also substantiated the advantages of the ecosystem approach in the development of human capital, the quality of which is in the interests of national development.

Main results of research: on the basis of domestic and foreign studies, the main directions for the analysis of innovative educational ecosystems from the standpoint of value created and contribution to the development of human capital are determined. The characteristic principles of modern innovation and educational ecosystems are identified, which are concretized through the analysis of the activities of the lean laboratory of Gazpromneft-Khantos on the basis of Yugra State University. The authors of the article substantiate the need for an integrated approach to assessing the potential of innovative educational ecosystems. Which includes value analysis from the perspective of all participants in the interactions. The authors also take into account the implementation of the fundamental principles of the ecosystem in conjunction with the key principles for the development of the national higher education system.

The purpose of research: based on the analysis of the transport and logistics infrastructure to identify the key areas of development of the Nizhnevartovsk district.

Methods and objects of research: the object of research is the investment potential of the municipality (Nizhnevartovsk district).General scientific methods of cognition were used in the theoretical understanding of theoretical approaches to the content of the concepts of transport and logistics potentials of territories, tabular and graphical methods were used in the analysis of transport and logistics infrastructure of Nizhnevartovsk district, methods of strategic analysis allowed to formulate key directions for the development of its transport and logistics complex. The methodology of the study is based on the analysis of official municipal statistics (presented on the official website of the Federal State Statistics Service of the Russian Federation) and planning and reporting program documents of the regional and municipal levels.

Main results of research: the components of the transport and logistics potentials of the territories were identified, as well as indicators of their assessment; the main indicators of transport and logistics infrastructure as the basis of transport and logistics potential were analyzed; strengths and weaknesses, as well as opportunities and threats to the development of transport and logistics infrastructure of the district were highlighted.

Purpose of research: to analyze the severity of the factors of subjective well-being of students and the inclusive environment of the school in conjunction with the socio-psychological characteristics of students, including those with disabilities.

Methods and objects of research: the empirical analysis included a study of satisfaction with school, family, oneself and one's life prospects, friends, as well as inclusive policies, inclusive practices, and inclusive culture at school. A continuous study of 807 students of the 7,8,9,10,11 th grades of the Tyumen city school was conducted. The study was conducted using the author's questionnaire. It is based on the questionnaire of the international research project on the study of subjective well-being of children "Detsky Mir" – Children's World and the questionnaire of T.Booth, M.Einscow.

Main results of research: a decrease in the level of assessment of subjective well-being with an increase in the class of study; a difference in grades depending on gender; a tendency to link well-being and an inclusive environment at school; a difference in the assessment of factors of subjective well-being and an inclusive environment of normotypical and students with disabilities. It is shown that one of the tools for the formation of an inclusive educational space can be socio-emotional learning. Inclusion, subjective well-being and socio-emotional learning make up the trinity of the education model. The construction of this model will ensure the necessary level of openness and accessibility of modern school education.

Social complementary dyads: historical trends of evolution

Abstract

Subject of research: "social complementary dyads" as a socio-psychological phenomenon. The object is social groups as socio-psychological phenomena, the subject is small social groups (microgroups) in the processes of their historical evolution.

Methods of research: historical-theoretical, analysis of the empirical studies on social groups subjects interactions. The phenomenon of the dyad as one of the forms of social groups is discussed.

Main results of research: a typology of dyads has been proposed: 1) complementary social dyads (SDS); 2) supporting social structures; 3) professional dyads (complex groups); 4) professional creative (creative dyads); 5) related; 6) spontaneous; 7) destructive (parasitic, exploitative); 8) antisocial. In view of the historical trends in the increase in the types of dyads and their varieties, it is believed that in the field of education the most urgent problem is the first type of dyads – complementary social dyads (SDS), represented by such combinations as "educator – educated", "teacher – student", "teacher – student”, etc. Open questions are singled out (study in the paradigm of individual rather than joint activity; binarity of group classifications; unresolved issues of the “lower” and “upper” limits of the generation and functioning of groups; evolution of the subjects of the dyad, etc.); promising aspects of further research are discussed (the problem of resources, the individuality and complementarity of the qualities of interacting subjects, the possibility of directed formation and control of the evolution of dyads, etc.).
