Abstract
The article deals with the problem of functioning of psychogenic mechanisms which determine the phenomenon of
legal nihilism. Author believes that social behavior of an individual should be explained by means of inter- and counteraction
of two opposing drives in every person: Eros (the instinct of life) and Thanatos (the instinct of death). The dominant
tendency in an individual development (Eros or Thanatos) determines his/ her behavior as a subject of law, his/ her relation
to reality and hierarchy of legal values, according to which legal regulations are to be accepted or denied.
